Justice Acknowledges State's Failure to Address Rural Violence in Contulmo and Orders Compensation
The first ruling that certifies the State's failure to serve victims of rural violence in the province of Arauco has been issued by the judiciary, ordering the payment of 200 million pesos as compensation.
The ruling states that despite the measures implemented, public security agencies have failed to resolve the conflict in the Southern Macrozone.
The resolution upheld the lawsuit filed last year by the Rivas Lacoste family, who since 2014 have suffered the occupation of much of their land in the commune of Contulmo, in addition to being targeted by arson attacks and threats.
The judge of the Second Civil Court ofConcepción, Adolfo Depolo, confirmed the State's failure to serve by concluding that although plans and measures to combat rural violence have been implemented, state agencies have failed to resolve the conflict, and consequently, the safety of residents in the Southern Macrozone remains compromised.
From the Victims' Association, spokesperson Fernando Fuentealba highlighted the ruling, as it confirms what victims have been denouncing for years.
Similarly, UDI deputy Flor Weisse commented but shifted part of the blame for the failure to serve away from the Presidential Delegation.
Regarding the possibility of the ruling setting a precedent, Democrat deputy Joanna Pérez believes this will indeed be the first of many similar rulings.
The ruling only addresses the moral damages caused but not the land occupation and ongoing threats against the Rivas Lacoste family, hence the outstanding debt in that regard, said their lawyer.
