Preventive Detention Upheld for Suspect Accused of Timber Theft and Illegal Possession of Weapons and Ammunition
- In addition to the year in detention he will complete next August 31, the defendant's cooperation with the investigation was argued before the Court, a precedent with which Sandoval will soon insist on the request.
The court upheld the preventive detention for Carlos Cigarroa, charged with illegal possession of weapons and ammunition, in addition to being investigated for timber theft in the province of Arauco, in the Bío Bío region.
Nearing a year since his arrest, Carlos Cigarroa argued a few days ago before the Curanilahue Guarantee Court about the time he has spent deprived of liberty and that, therefore, the precautionary measure could be replaced with a less severe one.
That request was denied, after which his defense attorney, Juan Claudio Sandoval, asked the Concepción Court of Appeals to review the ruling, which occurred this Wednesday, though unsuccessfully, as the appellate court confirmed the preventive detention.
In addition to the year in detention he will complete next August 31, the defendant's cooperation with the investigation was argued before the Court, a precedent with which Sandoval will soon insist on the request.
For Arauco Province Deputy Flor Weisse, the confirmation of preventive detention demonstrates the alignment and coordination of the penal system in combating serious crimes such as illegal possession of weapons and ammunition.
The defense attorney, who does not deny his client's responsibility in the charges filed, stated that in a potential trial, Cigarroa would benefit from supervised release and, therefore, preventive detention is no longer justified.
When Carlos Cigarroa was arrested, police found in his possession at his home six cartridges of various calibers, two 9-millimeter firearms with magazines and 24 rounds, as well as cell phones and 4 million 500 thousand pesos in cash.
