National grounding and monthly check-in for suspect accused of starting forest fire in Hijuelas
The emergency affected five hectares and forced a Red Alert to be declared for the area.
The Guarantee Court of La Calera ordered the precautionary measures of national grounding and monthly check-in at Carabineros de Chile for A.J.V.C., accused as the perpetrator of the completed crime of forest arson.
The individual is accused of starting the forest fire named "Oasis La Campana" in the Ocoa sector of Hijuelas, an emergency that affected five hectares and forced the commune to declare a Red Alert.
"Considering that the accused has an irreproachable prior record, that the self-reporting could potentially constitute some form of mitigating factor for criminal liability (...), and that if convicted, they could receive an alternative sentence to imprisonment, such as conditional suspension or supervised release, it would be disproportionate to impose a precautionary measure that deprives them of liberty, even partially. To ensure their appearance, I will decree national grounding and monthly check-in," ruled Judge Roberto Lizana.
The court set an investigation period of 120 days.
